Subrogation
(Use with CU 0002)
This endorsement allows the insurance company to waive its rights of recovery against the party listed on the endorsement schedule due to payments it made for injury or damage that arises from the following:
Note: This may be a superfluous endorsement because the named insured can waive rights of recovery in writing any time prior to a loss. However, certain entities may require this endorsement as a protective measure.
CU 1027–Personal and
Advertising Injury Liability–Limited Contractual Liability Coverage–Coverage P
(Use with CU 0002)
This endorsement removes coverage for covered contracts. It then adds back in contractual liability coverage for only liability the insured assumed for false arrest, detention, or imprisonment.
CU 1028–Known Injury or
Damage Amendment–Coverage E
(Use with CU 0001)
This endorsement amends the insuring agreement. It states that coverage applies to only bodily injury or property damage that is not a resumption of or a continuation of (or a change in) bodily injury or property damage that a designated insured knew about before the policy period began.
CU 1029–Cancellation
Amendment–Lessor of Autos
(Use with CU 0002)
The named insured may rent or lease an auto where the agreement requires that it provide primary coverage for the lessor. The lessor may also require that it be notified if coverage is cancelled. This endorsement is used to identify the lessor and the leased vehicle in such cases so that appropriate notices can be mailed.
CU 1030–Claims-Made
Coverage–Coverages L and P
(Use with CU 0002)
This
endorsement provides coverage on a claims-made basis over underlying insurance
written on a claims-made basis. It has an automatic five-year Basic Extended
Reporting Period. However, CU 1031–Supplemental Extended Reporting Period
provides an unlimited reporting period for an additional premium charge.
CU 1031–Supplemental
Extended Reporting Period
(Use with CU 0002)
This
endorsement is used with CU 0130–Claims-Made Coverage–Coverages L and P. It
provides a separate supplemental extended reporting period aggregate limit
equal to the aggregate limit on the declarations. It applies to claims first
received and recorded during the supplemental extended reporting period.
CU 1032–Fellow
Employee Auto Coverage–Coverage L
(Use with CU 0002)
This endorsement provides coverage for the liability of the named insured's employee who injures a fellow employee while driving an auto.
CU 1033–Auto
Coverage–Individual Named Insured–Coverage L
(Use with CU 0002)
This endorsement provides coverage for an employee's liability for bodily injury to a fellow employee of the named insured. Coverage also applies to a fellow employee of the named insured's resident family member caused by a covered auto. This endorsement defines resident family members and broadens the definition of you and yours to include a resident spouse.
CU 1034–Following Form
Pollution Coverage–Coverage L
(Use with CU 0002)
This endorsement initially excludes all pollution coverage. It then adds back in coverage that underlying insurance provides or would have provided except that its limit was used up.
CU 1035–Employee
Redefined–Coverage L
(Use with CU 0002)
This endorsement amends the definition of employee to exclude leased workers. However, it applies only with respect to the employer's liability under Coverage L exclusion n.
CU 1036–Coverage
E–Employee Benefits Liability Coverage–Claims-Made Basis
(Use with CU 0002)
This endorsement covers amounts an insured is legally obligated to pay as damages for an injury to an employee. The injury must be caused by a negligent act, error, or omission in administering an employee benefits program. The each claim and aggregate limits, the retained limit, and the retroactive date are entered on the endorsement schedule, along with the names of any additional insurance, plans, or benefits.
Note: This endorsement is a separate Coverage Form. The fact that it is referred to as Coverage E may be confusing because CU 0001 refers to its excess coverage as Coverage E.
CU 1037–Coverage
E–Employee Benefits Liability Coverage–Supplemental Extended Reporting Period
(Use with CU 0002)
This endorsement provides a separate supplemental extended reporting period aggregate for the same amount as the employee benefits liability coverage aggregate limit. It applies to claims first received/recorded during the supplemental extended reporting period. It begins when the basic extended reporting period ends.
CU 1038–Coverage
Z–Employment Practices Liability–Claims-Made Basis
(Use with CU 0002)
This endorsement covers liability that arises from wrongful employment practices. The each claim and aggregate limits, the retained limit, and the retroactive date are entered on the endorsement schedule.
Note: This endorsement is a separate Coverage Form. It is claims-made and defense is included within the limits.
CU 1039–Coverage
Z–Employment Practices Liability–Extended Reporting Period
(Use with CU 0002)
This endorsement provides a three-year extended reporting period that begins at the end of the policy period. A different number of years may be entered on the endorsement schedule. The separate aggregate limit is the same amount as the Coverage Z–Employment Practices Liability Aggregate Limit. It applies to claims eligible for coverage under the extended reporting period that occurred after the retroactive date, before the end of the policy period, and that were first reported during the extended reporting period.
